1. About These Terms

These Terms and Conditions (“Terms”) govern access to and use of the Pascal Canteen App, the related web portal at https://bitespsc.pascal.ac.cy, and the school canteen ordering services made available through them (together, the “Service”).

The Service is operated by Pascal Education (Cyprus) Ltd (“Pascal”, “we”, “us” or “our”), located at Pascal, 177 Kopegchagis Street, 2306 Lakatamia, Lefkosia, Cyprus. Pascal Education (Cyprus) Ltd is the provider of the school canteen service and the seller of the physical meals and drinks offered through the Service.

By using the Service, placing an order, or allowing a student to use a school-issued account, you agree to these Terms. If the user is under 18, these Terms should be reviewed and accepted by the user’s parent or legal guardian to the extent required by applicable law and the school’s arrangements.

Use of the mobile application may also be subject to the applicable terms of the Apple App Store or Google Play. These Terms govern the Pascal canteen service and do not replace any mandatory platform terms or statutory consumer rights.

2. Eligibility and School-Issued Accounts

The Service is intended for authorised students of Pascal Education (Cyprus) Ltd and for their parents, guardians and authorised school personnel. Student accounts are created and managed by the school. Students and parents cannot create a new student account inside the app.

Login credentials are issued or approved by the school. A parent or guardian may manage relevant account information through the related web portal, including credentials, an assigned payment card, daily spending limits, allergy information and purchase monitoring, where those functions are enabled.

The phone number stored for the account belongs to the parent or guardian and is used only for one-time-password (“OTP”) authentication. You must ensure that account details are accurate and kept up to date.

You are responsible for keeping credentials and OTPs confidential and for notifying Pascal promptly if you believe that an account has been accessed without authorisation. Accounts must not be shared with unauthorised persons.

3. Permitted Use

Pascal grants authorised users a limited, revocable, non-exclusive and non-transferable right to access and use the Service for personal school canteen purposes in accordance with these Terms.

You must not misuse the Service, attempt to bypass security or spending controls, access another person’s account, interfere with the operation of the Service, introduce malicious code, extract data through automated means, reverse engineer the application except where such restriction is prohibited by law, or use the Service for fraudulent, unlawful or commercial resale purposes.

4. Menus, Availability and Order Windows

The Service allows authorised users to view available products and place orders for selected school breaks. Product availability, menus, prices, collection times and order cut-off times may change according to school operations, stock, supplier availability and other reasonable operational requirements.

An item displayed in the Service is not guaranteed to remain available until the order has been successfully confirmed. Pascal may substitute, remove or cancel an unavailable item and will provide an appropriate refund or account adjustment where payment has already been taken.

Users are responsible for selecting the correct product, quantity, date and school break before confirming an order.

5. Order Confirmation

An order is accepted only when the Service displays a successful order confirmation or order code and records the order in the relevant Upcoming or History section. Adding an item to the cart or beginning payment does not by itself confirm the order.

Before placing an order, the user is shown the products selected, the applicable price and the payment obligation. The user must actively confirm the order and payment. Optional or additional charges will not be imposed through pre-selected choices.

Pascal may reject or cancel an order where a product is unavailable, the payment is unsuccessful, the account or spending limit does not permit the transaction, the order is placed after the applicable cut-off, or there is a technical, pricing or account error. Where payment has been collected for a cancelled order, Pascal will arrange an appropriate refund or account adjustment.

6. Prices and Payments

Prices are displayed in euros and are the amounts payable for the selected physical school meals or drinks unless otherwise indicated. Pascal may update prices for future orders. A price change does not affect an order that has already been successfully confirmed, except where there is an obvious pricing error and applicable law permits cancellation or correction.

Payments are processed through Viva.com. Card information entered during checkout is handled in the Viva.com payment environment. Pascal and the Pascal Canteen App do not receive or store full payment card numbers or CVV codes. Pascal may receive limited transaction information such as masked card details, a card reference, transaction identifier, payment status and the information needed to match the payment with an order.

A parent or guardian may assign a payment card and set spending limits through the related portal where this functionality is available. A spending limit is an account control and does not guarantee that an order will be accepted or that sufficient funds or payment authorisation are available.

Apple in-app purchase and Google Play Billing are not used because payments relate to physical school meals and drinks consumed outside the app.

7. Cancellations, Refunds and Account Adjustments

An order may be cancelled only while the cancellation option remains available in the Service and before the applicable order cut-off or preparation stage. Once the Service confirms a valid cancellation, any corresponding reserved amount, spending-limit amount or account balance will be restored where supported by the transaction flow.

Where a payment has already been settled through Viva.com, the time required for a refund to appear may depend on Viva.com, the card issuer and the payment method. If the cancellation option is no longer available, you may contact the school promptly, but cancellation cannot be guaranteed after preparation has begun.

Meals and drinks are perishable goods prepared or reserved for a particular school break. The ordinary statutory withdrawal right that applies to some distance purchases may therefore not apply after preparation has begun, the relevant cancellation window has closed, or the goods have been supplied, subject always to applicable consumer law.

Nothing in these Terms limits any mandatory rights available to consumers under Cyprus or European Union law.

8. Allergies and Food Information

A parent, guardian or authorised school administrator may provide allergy information for the relevant student account. The Service uses this information to hide or restrict products identified as containing relevant allergens.

Parents and guardians are responsible for ensuring that allergy information is accurate and promptly updated. The allergy filtering function is an operational assistance feature and does not provide medical diagnosis, treatment or medical advice. For serious allergies, special dietary requirements or safeguarding concerns, the parent or guardian must also communicate directly with the school through the school’s established procedures.

Product information and availability may change. Users should review the information displayed for each product and contact the school where clarification is required.

9. Collection and Use of Orders

Confirmed orders are intended for collection or use at the school and during the selected break or service period. Users must follow the school’s collection, identification and canteen procedures.

Pascal is not responsible for an order not being collected at the selected time where the meal was made available in accordance with the confirmed order, except where applicable law requires otherwise.

10. Service Availability and Updates

Pascal aims to keep the Service available and accurate but does not guarantee uninterrupted or error-free operation. Access may be temporarily unavailable because of maintenance, updates, internet connectivity, payment-provider availability, school closures, security incidents or circumstances outside reasonable control.

Pascal or its authorised technical service providers may release updates, security fixes or functional changes. Users may need to install an updated app version or use a supported browser or operating system to continue using the Service safely.

Pascal may modify or discontinue a feature where reasonably necessary for security, legal, operational or service-improvement reasons. Where a material change affects confirmed orders or user rights, Pascal will take reasonable steps to provide notice or an appropriate remedy.

11. Suspension and Termination of Access

Pascal may suspend or restrict an account where reasonably necessary to protect students, prevent misuse or fraud, investigate unauthorised access, comply with law, enforce school rules, or address a breach of these Terms.

An account may also be deactivated when the student is no longer actively enrolled or when the school determines that access is no longer required. Where appropriate and reasonably possible, Pascal will explain the reason for the restriction or provide a route to request assistance.

Parents, guardians or authorised users may request account deactivation or deletion of associated personal data by contacting info@pascal.ac.cy with the subject line “Data Protection Request”. Privacy and deletion requests are handled in accordance with the Pascal Canteen App Privacy Policy and applicable law.

12. Third-Party Services

The Service relies on third-party services where necessary, including Viva.com for payment processing and Apple or Google for distribution of the mobile application. Third-party services are governed by their own terms and privacy information.

Pascal is responsible for selecting and managing its service providers as required by applicable law, but it does not control independent payment networks, card issuers, app stores or internet-service providers.

13. Privacy

Personal data is processed in accordance with the Pascal Canteen App Privacy Policy, available at https://bitespsc.pascal.ac.cy/application/privacy-policy. The Privacy Policy explains the personal data processed, the purposes of processing, retention periods, payment-related data, allergy information, data-protection rights and how to contact the school Data Protection Officer.

14. Intellectual Property

The Service, its software, design, text, branding, logos, menus, images and other content are owned by Pascal Education (Cyprus) Ltd or its licensors and are protected by applicable intellectual-property laws.

No ownership rights are transferred to users. You may not copy, modify, reproduce, distribute, publish, sell or commercially exploit any part of the Service except with prior written permission or where permitted by law.

15. Liability

Pascal will provide the Service with reasonable care and skill. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or mandatory consumer rights.

Subject to the previous paragraph and to the maximum extent permitted by law, Pascal is not liable for losses that were not reasonably foreseeable, losses caused by incorrect information supplied by the user, unauthorised use resulting from failure to protect credentials, failures of third-party networks or payment services outside Pascal’s reasonable control, or failure to collect an order that was made available as confirmed.

Any limitation or exclusion in these Terms applies only to the extent that it is fair, transparent and enforceable under applicable law.

16. Changes to These Terms

Pascal may update these Terms to reflect changes to the Service, school operations, legal requirements or security practices. The updated Terms will be published at https://bitespsc.pascal.ac.cy/application/terms-and-conditions and will show the date of the latest revision.

Where a change materially affects users, Pascal will take reasonable steps to provide notice before the change takes effect where required by law. Continued use after the effective date constitutes acceptance of the updated Terms, subject to mandatory legal rights.

17. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Cyprus. The courts of Cyprus will have jurisdiction, without depriving a consumer of any mandatory protection or right to bring proceedings available under applicable law.

Before starting formal proceedings, users are encouraged to contact Pascal so that the matter can be reviewed and, where possible, resolved informally. These Terms do not require binding arbitration and do not remove any right to complain to a competent consumer-protection, data-protection or other public authority.

18. General Provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect. Failure to enforce a provision immediately does not waive the right to enforce it later.

These Terms, together with the Privacy Policy and any specific school or order information presented through the Service, form the agreement governing use of the Pascal canteen Service. Where mandatory law conflicts with these Terms, mandatory law prevails.
